Terms and Conditions Agreement

This Agreement governing the terms and conditions of your use of Green Can Cleaner service is between you (“you” or “Customer”), as an authorized user of such services, and Green Can Cleaner Inc. (The Service).

This Agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Green Can Cleaner Inc. (collectively, the “Agreement”), constitutes the entire greement between Green Can Cleaner Inc. and you regarding the Green Can Cleaner cleaning service. By using the Service, you confirm your acceptance of and agree to be bound by this Agreement.

Service

Green Can Cleaner Inc. offers the Service at its website https://www.GreenCanCleaner.com or by calling (720)692-7151 or (720)692-7895. The Service is a trash can cleaning service that initiates a recurring subscription for selecting any of the recurring service plans. This subscription renews automatically unless canceled prior to your anniversary date and must be in writing and delivered by email to Info@GreenCanCleaner.com or PO Box 631511 Littleton, CO 80163.

Customer Responsibilities

Communication Green Can Cleaner Inc. provides email notifications for notifications regarding your service; please ensure that notifications@getjobber.com is whitelisted to ensure that Green Can Cleaner’s communication is not sent to your junk email folder.

Green Can Cleaner Inc. Provides text message notifications for notifications regarding your service; please ensure that you are able to receive text messages from (720)802-5015.

While Green Can Cleaner Inc. tries to provide reminders it the customers’ responsibility to ensure the proper contact information is provided. Green Can Cleaner Inc. will do everything in it’s power to ensure reminders are sent but Green Can Cleaner Inc. is not responsible to ensure a contact is made. It is the customers responsibility to have the correct number of cans available for cleaning on the cleaning day.

Day of Service For same day service the cans to be cleaned should be left curbside after the contents have been collected. Service is provided from 10:00 a.m. to 10:00 p.m. For next day service the trash cans should be curbside by 8:00 a.m. If this is not possible they should be visible from the street & readily accessible. Service is provided from 8:00 a.m. to 10:00 p.m.

Cans may have up to 2 medium size bags of garbage. However, we reserve the right to refuse service if any can has any of the following.

  1. More than 2 bags of trash or any bag that weighs over 20 lbs.
  2. Loose, unbagged, trash, yard clippings, diapers or animal waste.
  3. Hazardous waste including chemicals, paint, glue, or other adhesives
  4. Building materials like plaster, stucco, or concrete.

Rescheduling Fee for Recurring Service If your can(s) can not be serviced on the scheduled day, please notify us before 9:00 a.m. the day of service, and we will reschedule your cleaning for the following month. If you do not notify us, we will charge a $25.00 trip charge when we arrive at your property.

Rescheduling Fee for Non-recurring service plans. If your can(s) can not be serviced on the scheduled day, please notify us before 9:00 a.m. the day of service, and we will reschedule your cleaning for the following month. If you do not notify us and Green Can Cleaner Inc. dispatches our truck to your home and can not provide service due to circumstances beyond our control, you will be notified why we could not provide service. Due to the cost associated with sending our employee and vehicle to your home no refund can be provided.

Cancelation of Service Cancelations must be made in writing and delivered by email to info@GreenCanCleaner.com or mailed to PO Box 631511 Littleton, CO 80163. Cancellation notifications must be received prior to 8:00 a.m. on the day of service. There are no refunds after 8:00 a.m. on the day of service.

Green Can Cleaner Inc.’s Responsibilities

If Green Can Cleaner Inc. fails to provide its service on the scheduled day of service for a reason other than the customer failing to meet his/her responsibilities in the paragraphs above, Green Can Cleaner Inc. will compensate the Customer by one of the following methods at its sole discretion.

  1. Arranging for the service to be performed on the next possible business day.
  2. Crediting the customer for the missed service.
  3. Rescheduling the service to the next day Green Can Cleaner Inc. is in the area.

Modifications to Customer Agreement

Green Can Cleaner Inc. may amend this Agreement at any time by (a) posting a revised Customer Agreement at https:// www.GreenCanCleaner.com and/or (b) mailing or sending information regarding the amendment to the email address provided to Green Can Cleaner Inc. by the customer. We welcome all inquiries, questions and comments regarding any changes made to the agreement from our clients. Our goal is to always serve our clients to the best of our ability. Any changes to the agreement would be solely made for the betterment of the service program.

Modifications to Service

Green Can Cleaner Inc. reserves the right to modify our delivery of service for the betterment of our clients and the overall success of the service program.

Charges

You agree to pay all charges for your use of the service at the prices in effect for your area of residence at the time of sign-up. All charges will be exclusive of value added sales or other taxes, except as required by law. Green Can Cleaner Inc. reserves the right to change prices or institute new charges for access to or use of the service. Any changes in pricing will be communicated to you by telephone, mail, email or text. It is your right to continue the service after your term or to discontinue the service at that time. Continued use of the services or non-termination of your Green Can Cleaner account after changes are communicated to you by telephone, telephone message, mail, email or text correspondence constitutes your acceptance of the prices as modified by the posted changes.

Payment for your Green Can Cleaner Inc. service is due in accordance with your cycle of payment and must be made by the credit card designated by you. Charges will be billed based upon your agreed payment schedule for the service that you have selected. If payment by credit card to Green Can Cleaner Inc. is not honoured or fulfilled by the issuer of your credit or debit card (or its agent or affiliate), you agree to pay all amounts due upon demand by Green Can Cleaner Inc. Each time you use the service you agree and reaffirm that Green Can Cleaner Inc. is authorized to charge your designated card. Your card issuer’s agreement governs your use of your designated card in connection with Green Can Cleaner Inc. and you must refer to that agreement with respect to your rights and liabilities as a cardholder.

You must promptly notify Green Can Cleaner Inc. of changes to: (a) the account number or expiration date of your designated credit or debit card; (b) your billing address (for the designated credit or debit card); and promptly notify Green Can Cleaner Inc. if your card is cancelled (e.g., for loss or theft). Your service is a recurring charge, based upon your service schedule to the authorized credit card. You may opt out of future recurring charges at any time, as long as notice is received before the next billing date of your most recent sign-up by canceling via email at info@GreenCanCleaner.com.

Note: If you cancel a recurring service after the first cleaning, you authorize Green Can Cleaner Inc. to charge the credit card on file for the difference between the recurring service price selected and the published One-Time service price. The minimum one-time cleaning fee for new customers is currently $90.00. Example If you order monthly service for two cans, your first cleaning is $30.00. If you cancel after the first cleaning, you authorize Green Can Cleaner Inc. to charge the card on file $60.00. The difference between $90.00 and the $30.00 initial payment. Green Can Cleaner Inc. reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges or if your card issuer (or its agent or affiliate) seeks return of payments previously made to Green Can Cleaner Inc. when Green Can Cleaner Inc. believes you are liable for the charges. Such rights are in addition to, and not in lieu of, any other legal rights or remedies available to Green Can Cleaner Inc.

All services are due and payable when invoiced. Any invoice unpaid for a period of 10 days will be subject to a late fee of $10.00 or 10 percent whichever is greater. Any invoice unpaid for a period of 30 days is subject to an additional late fee of $25.00. Any invoice unpaid for a period of 60 days is subject to an additional late fee of $50.00. 

Miscellaneous

The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights. If any part, term or provision of this Agreement is held to be illegal or unenforceable neither the validity nor enforceability of the remainder of this Agreement shall be affected.

Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party. This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently supersedes all prior representations, writings, negotiations or understandings with respect hereto.

Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil commotion or industrial dispute. If such delay or failure continues for at least 30 days, the Party not affected by such delay or failure shall be entitled to terminate this Agreement by notice in writing to the other.
